EB-5 petitions filed by September 30, 2026 lock in the current rules and investment thresholds under the Regional Center Program's grandfathering provision, even though final adjudication happens later. The Regional Center Program itself is authorized through September 30, 2027, but the required investment amount is scheduled to rise on January 1, 2027 under the statute's CPI-linked adjustment — current estimates put the new minimum near $937,500 for the reserved categories.
For Indian investors, timing matters even more: as of the August 2026 Visa Bulletin, the unreserved EB-5 category is Unavailable for India, while the rural, high-unemployment, and infrastructure set-aside categories remain Current — meaning a correctly filed set-aside petition today faces no backlog.
